On August 24, the Ministry of Justice published a decree allowing entrepreneurs to request the confidentiality of their home address listed in the Trade and Companies Register (RCS).

In line with the proposals put forward by Adan during the meeting held on May 16 at the Ministry of the Interior, in the presence of Bruno Retailleau, this decree now enables any company director or shareholder to request the concealment of their personal address in the register.
Practically speaking, this request can be made via the online business portal (guichet unique), will be processed by registries within five working days, and only authorized authorities will be able to access this information as part of their official duties.

This first significant step will be followed in the coming months by a bill proposed by MP Paul Midy, expected to be discussed before 2026. This legislative initiative will further strengthen the protection of business leaders, particularly regarding the dissemination of their personal data on platforms such as Pappers or Société.com.

Key measures proposed in the bill include:

  • Requiring INPI, Infogreffe, and Insee to provide redacted registry documents, removing home addresses and other private information.
  • Deleting personal data from documents that have already been made public.
  • Allowing entrepreneurs to hide their home address when it coincides with their business address.

Adan will continue to work closely with members of Parliament to strengthen this bill and ensure a comprehensive and lasting protection for company directors.
